§1 General Provisions
1.1. 1.1. These Terms and Conditions (hereinafter referred to as the “Terms”) define the rules for Customers and Consumers using the Online Store www.bellasicilia.pl, and in particular regulate:
a) the conditions for concluding and performing sales agreements;
b) the conditions for providing services by electronic means;
c) the rules governing Consumers’ right to withdraw from the agreement without giving a reason;
d) the rules and procedure for handling complaints.
1.2. 1.2. Electronic correspondence regarding the activities of the Online Store should be sent to:

1.3. 1.3. A Customer of the Online Store may be a natural person, legal person, or an organizational unit without legal personality who wishes to conclude or has concluded a sales agreement with the Seller.
1.4. 1.4. Orders are processed only within the territory of Poland. In order to place an Order with international shipping, the Customer should contact the Seller individually to determine whether such shipment is possible.
1.5. 1.5. Prices in the Online Store are expressed in Polish zloty (PLN) and include VAT at the applicable rate (gross prices). Prices do not include shipping costs, which depend on the payment and delivery method chosen by the Customer. The Customer is informed about delivery costs during the order process.
1.6. 1.6. In order to avoid potential discrepancies or errors, it is recommended that devices used by Customers to access www.bellasicilia.pl meet at least the following technical requirements necessary to cooperate with the IT system used by the Seller:
a) a computer or other mobile device with Internet access;
b) a web browser such as:
- Internet Explorer version 8.0 or newer
- Mozilla Firefox version 3.x or 12.0 or newer
- Google Chrome version 23.0 or newer
- Opera version 11.0 or newer
- Safari version 5.0 or newer

monitor resolution 800 × 600, colors 16, 24 or 32 bit
possession of an active e-mail account.
1.7. 1.7. Customers may access these Terms at any time via a link available on the homepage of www.bellasicilia.pl, download them and print them. Each time, the Terms are also attached in PDF format to the e-mail confirming the final details of the Order.
1.8. 1.8. The Seller conducts sales exclusively through the Online Store. No stationary sales are conducted.
§2 Definitions
1.2. For the purposes of these Terms:
a) Online Store – the online store operating at www.bellasicilia.pl.
b) Seller / Data Controller – Ewelina Majkowska, ul. Ks. J. Popiełuszki 3/118, 01-786 Warsaw, Poland, NIP: 5222882983, REGON: 365238486, registered in the Central Register and Information on Economic Activity.
c) Customer – a natural person, legal person, or organizational unit without legal personality using services provided electronically who intends to conclude or has concluded a sales agreement with the Seller.
d) Consumer – a natural person performing a legal act with an entrepreneur that is not directly related to their business or professional activity.
e) Order – a declaration of the Customer’s intention to conclude a sales agreement. Proper submission of an Order results in the Customer receiving an e-mail titled “Order 3.7. Confirmation”.
f) Distance contract – a contract concluded with a Consumer under an organized system for distance contracts without the simultaneous physical presence of the parties.
g) Registration – creation of a Customer Account in the Online Store system through completion of the registration form and acceptance of these Terms.
h) Price – the amount payable by the Customer for selected products in the event of concluding a sales agreement. The price is expressed in PLN and includes VAT.
i) Delivery – entrusting the shipment of products intended for the Customer to third-party courier companies.
§3 Conclusion of the Sales Agreement
3.1. 3.1. The Seller undertakes to provide electronic services within the scope and under the conditions specified in these Terms.
3.2. 3.2. The Customer may place an Order in the following ways:
a) after prior registration in the Online Store system;
b) without registration (“quick purchase”).
3.4. 3.4. When selecting quick purchase, the Customer selects a product, clicks “add to cart”, proceeds to checkout, provides contact and delivery details, selects the delivery method, accepts the Terms, chooses a payment method, and confirms the Order by clicking “Order with obligation to pay”.
3.5. 3.5. When placing an Order, the Customer is required to provide truthful information.
3.6. 3.6. During the Order process and when creating a Customer Account, it is necessary to confirm acceptance of these Terms.
3.7. 3.7. An Order is placed when the Customer clicks the “order with obligation to pay” button or equivalent wording.
3.8. 3.8. After the Order is received, an automatic confirmation e-mail will be sent to the Customer. This message does not constitute confirmation of a distance contract.
3.9. 3.9. The Order confirmed by the store system constitutes an offer within the meaning of Article 66 §1 of the Polish Civil Code.
3.10. If the Seller does not confirm the Order within 48 hours via e-mail titled “Preparation in progress”, the Order ceases to be binding.

3.12. 3.12. The sales agreement is concluded when the Customer receives confirmation of order processing.
3.13. 3.13. The Customer may cancel or modify the Order only if it has not yet been shipped.
3.14. Orders are processed on business days from Monday to Friday, 9:00–18:00.
3.15. Information presented in the Online Store does not constitute an offer within the meaning
3.14. of the Civil Code but an invitation to submit offers.

§4 Order Processing, Delivery and Payment
4.1. 4.1. The Order will be fulfilled provided that the product is available in the Store’s warehouse.
4.2. 4.2. Orders are prepared within 3 business days from the date of conclusion of the agreement.
4.3. 4.3. Orders are shipped only within Poland. For international shipping, the Customer must contact the Seller.
4.4. 4.4. Delivery time depends on the delivery method chosen by the Customer.
4.5. 4.5. Delivery may be carried out by:
- • InPost
- • DPD Poland
4.6. 4.6. The Customer is obliged to pay the price of the goods and the shipping costs indicated in the Order.
4.7. 4.7. Product prices include VAT and are expressed in PLN.
4.8. 4.8. Payment may be made via:
a) bank transfer
b) PayU electronic payment
c) Visa / MasterCard payment card
d) cash on delivery
4.9. 4.9. The price shown at the time of placing the Order is binding.
§5 Receipt of Goods
5.1. 5.1. The Customer has the right to check the condition of the shipment before accepting it from the carrier.
5.2. 5.2. If damage is discovered before delivery, the carrier must prepare a damage report.
5.3. 5.3. If hidden damage is discovered after delivery, the Customer may request an inspection within 7 days of receipt.
5.4. 5.4. In case of problems or doubts, the Customer should contact the Seller.
§6 Withdrawal from the Agreement
6.1. 6.1. A Consumer who has concluded a distance contract may withdraw from it within 14 days without giving a reason.
6.2. The 14-day period begins on the day the product is delivered.
6.2. 6.4. In the event of withdrawal, the contract is considered not concluded.
6.3. 6.5. Payments will be refunded using the same payment method used by the Consumer.
6.4. 6.6. The Consumer bears the direct cost of returning the goods.
6.5. 6.7. If a more expensive delivery method was chosen, the Seller refunds only the cheapest standard delivery cost.
6.6. 6.8. The Consumer is responsible for any reduction in the value of the goods resulting from use beyond what is necessary.
6.7. 6.9. Information about withdrawal rights is provided to the Consumer on a durable medium.
6.8. 6.10. The right of withdrawal does not apply to:
6.9. a) goods that deteriorate quickly or have a short shelf life;
6.10. b) sealed goods that cannot be returned after opening
6.10.1. for health
6.10.2. or hygiene reasons.
6.11. 6.11. These provisions do not affect the Consumer’s right to submit a complaint.
§7 Complaints
7.1. 7.1. The Seller is liable for defects in accordance with the Civil Code.
7.2. 7.2. Complaints should be sent to:

7.4. 7.5. The response to the complaint will be sent to the Customer.

§8 Final Provisions
8.1. 8.1. The contract content is stored and provided:
a) via e-mail sent to the Customer;
b) via printed order specification and proof of purchase included with the shipment.
8. 2. 8.2. The contract is also stored in the Seller’s IT system.
8.3. 8.3. Consumers may use out-of-court dispute resolution methods, including consumer arbitration courts.
8.4. Disputes with Customers who are not Consumers shall be resolved by the court competent for the Seller’s registered office.
8.5. Matters not regulated by these Terms are governed by
Polish law,
8.4. including the Civil Code and the Act on the provision of electronic services.
